1. Acceptance of Terms
By accessing or using BatchQ ("the Service"), available at batchq.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
BatchQ is a software-as-a-service platform that uses artificial intelligence to assist users in identifying, pricing, and listing trading cards on third-party marketplaces such as eBay. The Service processes card images, generates listing information, and facilitates listing creation through authorized API integrations.
3. Beta Program
The Service is currently in beta. Features may change, be removed, or experience downtime without notice. Access to the beta requires an invitation code. BatchQ reserves the right to revoke beta access at any time for any reason.
4. User Accounts
You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
5. eBay Integration
The Service connects to your eBay account through eBay's OAuth authorization flow. By connecting your eBay account, you authorize BatchQ to create draft listings and access listing-related data on your behalf. You remain solely responsible for all listings created on your eBay account, including their accuracy, pricing, and compliance with eBay's policies. BatchQ does not guarantee that any listing will be successful, accurate, or compliant with eBay's terms.
6. User Content
You retain ownership of all images and content you upload to the Service. By uploading content, you grant BatchQ a non-exclusive, worldwide license to process, store, and transmit your content solely for the purpose of providing the Service. You represent that you have the right to upload all content you submit.
7. AI-Generated Content
The Service uses artificial intelligence to identify cards, suggest titles, descriptions, and pricing. AI-generated content is provided as suggestions only. You are responsible for reviewing and verifying all AI-generated content before publishing listings. BatchQ makes no guarantees regarding the accuracy of AI identifications, pricing suggestions, or market comparisons.
8. Pricing and Payments
During the beta period, the Service is provided free of charge. BatchQ reserves the right to introduce pricing plans in the future with reasonable notice to existing users.
9. Prohibited Uses
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse engineer, decompile, or disassemble the Service; (c) interfere with or disrupt the Service or its infrastructure; (d) create multiple accounts to circumvent usage limits; (e) resell or redistribute access to the Service without authorization; (f) upload content that infringes on the intellectual property rights of others.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BATCHQ AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. THIS INCLUDES BUT IS NOT LIMITED TO: INACCURATE CARD IDENTIFICATIONS, INCORRECT PRICING SUGGESTIONS, FAILED OR ERRONEOUS EBAY LISTINGS, LOSS OF EBAY ACCOUNT STANDING, OR ANY OTHER DAMAGES RESULTING FROM RELIANCE ON AI-GENERATED CONTENT. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
11. Indemnification
You agree to indemnify and hold harmless BatchQ and its operators from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights including eBay's terms of service.
12. Account Termination
BatchQ reserves the right to suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and associated data at any time by contacting us.
13. Changes to Terms
BatchQ reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
